A Systemic Issue
The Oversight Board highlighted systemic human rights concerns, particularly in how Meta handles account violations using a two-system approach: one involving strikes and another for 'egregious' violations that lead to permanent bans. The board noted that the distinction between these types of violations is not clearly defined, leading to confusion among users.
Lost Accounts, Financial Impact
The consequences are severe for innocent users who have lost personal or business accounts due to false accusations. Richard Pauwels, a retired LA County firefighter and paramedic, built a wellness brand on Meta's platforms but found his account banned without any specific post being identified or human review.
Manomi Jayakody, a PR professional, was banned for alleged child sexual exploitation (CSE) violations despite no content being cited in the ban. Similarly, a bird rescue operation was also banned under CSE grounds, even though it had over 60K followers and regularly used the account to contact volunteers.
No Support or Appeal Process
Another user, Albert Olgaard, with 325,000 Instagram followers, reported his accounts being shut down overnight for allegations of 'fraud,' without any citations. When he attempted to appeal, the response was a message stating that another review of this decision was not possible.
Business owner Alex [last name withheld] faced similar issues, with his account permanently disabled despite being tied to legitimate business activities. He suffered ongoing business disruption and significant stress without any meaningful human review through Meta's support channels.
Board Recommendations
The Oversight Board recommended that Meta offer users a dashboard where they can easily review their account stats, past violations, and information on appeal options. Clear notifications about the violations should be provided at the time of imposition, including the specific rule violated, the sanction imposed, and appeal options.
Meta's Response
In response to the board’s report, Meta shared a statement: 'We welcome the Oversight Board’s decision on this case. The Board upheld Meta’s decision to permanently disable an account. After conducting a review of the recommendations provided by the Board, we will update this post with initial responses to those recommendations.'
